Before June 6, 2012, by the tribunal de commerce of Paris, in the dispute between my sports channel and the CSA, the competition authority shall give an opinion on the compatibility of the tender, launched in 2010 by the CSA for the allocation of the rights to broadcast the matches of League 2 for seasons 2010/11 to 2013/14, with the rules in competition law.
April 2, 2010, the tender launched in February is declared unsuccessful by the League.
After a negotiation over the counter, she attributes in May 2010 the best poster (lot 1) to Eurosport and reserves the other 9 matches of each day of Championship (lot 2) for its CFoot chain.
My Sport chain, who saw his candidacy rejected, decides to attack in August 2010 the regularity of the tender by requesting its cancellation and payment of damages EUR 24.6 million.
It is in this framework that the tribunal de commerce of Paris seeks the opinion of the competition authority.
It is required to make an opinion on compliance to the right of the competition the three following points:
- the terms and conditions of the call for tender issued by the CSA in February 2010;
- the criteria for allocation and philosophies of human candidates to tender;
- the exploitation of the rights of lot 2 by the CSA itself.
The competition authority must in principle to rule in the coming days.
